Terms of Service

These Terms of Service ("Terms") govern your use of TextAnOrder's SMS ordering service (the "Service"), operated by TextAnOrder ("we", "us", "our"). By signing up for or using the Service, a Merchant agrees to these Terms.

The Service

TextAnOrder allows a Merchant's customers to place orders via SMS text message. The Service syncs with a Merchant's existing point-of-sale ("POS") system to keep menu items and pricing accurate. We are not a POS system and do not process payments; we facilitate the transmission of orders to the Merchant.

Merchant Responsibilities

• Provide accurate business and POS connection information.
• Ensure that customers who place orders via SMS have consented to receive text messages related to their order.
• Comply with applicable laws, including messaging and consumer protection laws, in connection with use of the Service.
• Fulfill orders received through the Service in a timely and professional manner.

Fees

Fees for the Service are agreed upon between TextAnOrder and the Merchant at signup and may be updated with reasonable notice.

Service Availability

We aim to keep the Service available and accurate but do not guarantee uninterrupted operation. We are not liable for order errors caused by inaccurate or delayed data from a Merchant's POS system.

Termination

Either party may terminate use of the Service at any time. Upon termination, we will stop processing new orders on the Merchant's behalf.

Limitation of Liability

To the fullest extent permitted by law, TextAnOrder is not liable for indirect, incidental, or consequential damages arising from use of the Service.

Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
